2. Data Collected

Through the contact and quote request forms, the following personal data is collected: full name, email address, phone number (optional), company or project (optional) and message/request description.

3. Purpose of Processing

Data is collected exclusively to respond to information requests and quote preparation, without any use for third-party commercial purposes.

4. Legal Basis

Processing is based on the data subject's consent, under Article 6(1)(a) of Regulation (EU) 2016/679 (GDPR).

5. Retention Period

Data is retained for a maximum of 24 months after receipt of the request, unless a legal obligation requires otherwise or consent is renewed. After this period, data is securely deleted.

6. Sub-processors and Infrastructure

Data submitted through the forms is sent directly to the controller's email, managed by Hostinger, a web hosting company with servers located in the European Union. No CRM tools, email marketing platforms or any other additional data processors are used.

7. International Transfers

Personal data is processed within the European Economic Area (EEA). No transfers to third countries are made.

8. Cookies and Tracking Technologies

This website does not use tracking cookies, analytics cookies, conversion pixels or any other user behavior monitoring technologies. Strictly functional cookies necessary for the technical operation of the site may be used, which do not require consent under GDPR.

9. Data Subject Rights

The data subject has the right to: access, rectification, erasure, restriction of processing, portability, objection and withdrawal of consent at any time, without affecting the lawfulness of processing carried out before withdrawal.

10. Exercising Your Rights

To exercise your rights, contact us via email at geral@filipemacau.com. The request will be answered within a maximum of 30 days, which may be extended to 90 days in cases of particular complexity, with notification to the data subject. You also have the right to lodge a complaint with the national supervisory authority, CNPD, at www.cnpd.pt.

11. Sharing with Third Parties

Personal data is not shared, sold or transferred to third parties for commercial purposes.

12. Security

Appropriate technical and organizational measures are adopted to ensure the security of personal data against unauthorized access, loss or destruction.

13. Minors

The services offered can be contracted by persons of any age. No services with content exclusively intended for those over 18 are provided. If the data subject is under 16 years of age, consent must be given or authorized by the holder of parental responsibility.

14. Changes to this Policy

This policy may be updated periodically to reflect legal or operational changes. The "last updated" date at the top of the document will always be revised accordingly. Regular consultation of this page is recommended. In case of substantial changes, a visible notice will be made on the website.

Terms & Conditions

2. Purpose

These Terms and Conditions govern the provision of services in the areas of multimedia, technology, graphic design, photography, videography, web development and IT support.

3. Quotes

Quotes are valid for 30 days from the date of issue and are only binding after written acceptance by the client. Absence of response does not constitute acceptance.

4. Payments

Projects valued at 200 EUR or above require a 50% deposit upon quote approval, with the remaining balance due upon delivery. Projects under 200 EUR are paid in full at the start of work.

5. Changes to Project Scope

Any change to the initially agreed project scope, including addition of features, requirement changes or requests outside the original scope, may result in a revised quote and/or delivery timeline. These changes will always be communicated to the client before execution and require written acceptance.

6. Cancellation

In case of project cancellation by the client, no refund of amounts already paid, including the deposit, will be made. In case of cancellation attributable to the provider, 50% of the deposit paid will be refunded to the client. In both cases, work completed up to the cancellation date is invoiced proportionally, with amounts already paid deducted from the total due.

7. Deadlines

Delivery deadlines are defined based on the nature of the project, availability of materials and timeliness of client feedback. Delays caused by the client in delivering materials or approvals may result in revised agreed timelines, without provider liability.

8. Travel

Travel is charged only when the nature of the service requires physical presence and no viable remote alternative exists. When applicable, travel costs will be indicated in advance in the quote or communicated to the client before travel.

9. Intellectual Property

All usage rights over produced works are transferred to the client after full payment of the agreed amount. The provider always retains authorship rights over all pieces and content produced, in any service area.

By default, the provider may reference and share completed works in their portfolio, social media and promotional materials. If the client wishes the works to be treated confidentially, a 50% surcharge on the total project value applies, to be included in the quote upon express client request.

Final files and deliverables, without watermarks or restrictions, will only be made available to the client after confirmation of full payment. No definitive versions of any work will be delivered with outstanding payments.

The provider also retains the moral right of authorship over all produced works, under the Copyright and Related Rights Code, and works may not be attributed to third parties or presented without identification of their origin.

10. Confidentiality

Both parties commit to keeping all information exchanged within the scope of service provision confidential, unless express authorization to the contrary or legal obligation.

11. Liability

The provider's liability to the client is limited to the total amount paid for the project in question. No liability is assumed for indirect damages, data loss, business loss or any other consequential damages not directly attributable to the provider.

12. Changes to these Terms

These Terms and Conditions may be updated periodically. The version in force at the time of quote acceptance applies to the established contractual relationship.

13. Dispute Resolution

These Terms are governed by Portuguese law. In case of dispute, the court of the provider's jurisdiction is competent, without prejudice to recourse to alternative dispute resolution means.

14. Alternative Dispute Resolution

In accordance with Article 18 of Law No. 144/2015, in case of consumer dispute, the consumer may use the Consumer Portal at www.consumidor.gov.pt.
